(a) Explain why there are different standards of review of arbitration awards depending on whether the arbitration is voluntary or statutorily mandated.
(b) Barbara and Cole, Inc., disputed the amount of money due as “minimum royalties” under a mineral lease. They submitted the dispute to arbitration, and the arbitrators awarded Barbara $37,214.67. The court held that there was no substantial evidence in the record to support an award of less than the minimum royalty of $75,000 and directed entry of a judgment for that amount. Was it proper for the court to increase the award? Why or why not?
